The Supreme Court (SC) in its order dated 3 December 2024 in Aureliano Fernandes v. State of Goa and Ors (Mis Application Diary No(s).22553/2023) directed State Governments and Union Territories to complete a survey to determine the number of organisations (public sector as well as private sector) which have already constituted an Internal Complaints Committee (ICC) in compliance with the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 (POSH Act). The Court had also recommended establishment of State wise SHE-Box platforms to register complaints under the POSH Act before the ICC of the workplace or through a local committee of a district.
By its order dated 12 August 2025 the Supreme Court has now imposed a 6 week deadline to complete the survey and directed Labour Departments to take actions under the provisions of the POSH Act where such ICCs have not been constituted.
RECENT LOCAL DEVELOPMENTS
- The Department of Women and Child Development, Government of NCT Delhi issued a notice directing all public sector, private sector offices and their subordinate offices to register their organisational details with SHE-Box portal.
- The District Women and Child Development Officer of Mumbai issued a public notice requiring all establishments with 10 or more employees to set up ICC and directed all private establishments in the Mumbai District to register their ICC on the SHE-Box portal.
- The Karnataka Department of Labour issued an order to all labour officers to take immediate actions to ensure compliance with the POSH Act.
- The Office of the District Collector and District Magistrate, Jaipur, issued a public notification directing all employers operating in Rajasthan to register their ICCs on the SHE-Box portal.
- The Government of Tamil Nadu issued a Standard Operating Procedure to guide the effective implementation of the POSH Act.
